It is unfortunate that the NCAA is not a forward thinking organization,
The NCAA has a lot of problems and putting the screws to the schools for something shoe companies are doing is not the smartest move.
You look at what was going on in football and the four super conferences with sixteen teams that walk away from the NCAA. I don't think anyone put the billion dollar march madness basketball tourney in the equation.

Wetzel's allowed to have - he must have - a point of view. But, woof.
Is the NCAA tournament favorite the NCAA's least favorite team?

Tell me - why in the fuck exactly would anyone cooperate or admit anything? I'll wait...go ask Mizzou for me.The defiant intensity of KU’s response — which includes three separate Level I violations — was expected. Yet it is still something to behold when actually put to paper. There is little cooperation here. There are few admissions. This is a direct confrontation, much like a legal case in which guilt or innocence is an all-or-nothing proposition.

Um, because that's exactly what it is.

Right - and the NCAA has made clear that it will not play fair, or give any credit for cooperation/admissions.NDballer13 wrote: ↑Fri Mar 06, 2020 1:12 pm "This is a direct confrontation, much like a legal case in which guilt or innocence is an all-or-nothing proposition."

Here we are subjected to the arbitrary whims of ncaa kangaroo court.

That's just a step in the process, if the NCAA decides to go that route. If the NCAA rules in their kangaroo court that KU is guilty, then you can bet everything you have it becomes a legit "legal case" where brudens of proof come into play.ousdahl wrote: ↑Fri Mar 06, 2020 1:46 pmWith the only difference being. - a legal case has established procedures and burdens of proof.NDballer13 wrote: ↑Fri Mar 06, 2020 1:12 pm "This is a direct confrontation, much like a legal case in which guilt or innocence is an all-or-nothing proposition."

Of course, before that time comes, you will have the NCAA making technical arguments about how none of these matters can be properly brought before a real court, in any case.NDballer13 wrote: ↑Fri Mar 06, 2020 1:55 pmThat's just a step in the process, if the NCAA decides to go that route. I'm not good at legal shit, but can't any dispute in an organization or association be brought forth in a real court case?

You can contract out of the right to bring claims in court. You probably do it all the time without really paying much attention (have a look at, say, your credit card or cell phone terms of service).NewtonHawk11 wrote: ↑Fri Mar 06, 2020 2:16 pmI'm not good at legal shit, but can't any dispute in an organization or association be brought forth in a real court case?
I gather, from the way the various committees are described here, that there's language in the bylaws or somewhere else where schools purportedly give up their right to appeal decisions in court. That won't stop KU from trying, but they'll be fighting the words on the page.

Thanks for respond Fish. It's going to be a definite mess. But KU is going to fight it as hard and as long as they possibly can.
And they should.

This has certainly put a 'stain' on the KU name forever but it is still best for KU to keep pushing this as long as possible. Go the UNC route; don't back down and eventually the NCAA will cave. With as fast as this world is moving these days and the hot button that has become amateur sports KU should hold fast and firm on its stance.NewtonHawk11 wrote: ↑Fri Mar 06, 2020 2:21 pm Thanks for respond Fish. Now, this would only make your spidey sense tingle a bit if you had any reason to think the NCAA had the capacity for being extremely petty, shortsighted and disproportionate.

You know...I hate to even bring him up, because I know that there are posters who will immediately respond: BuT hE wAs A CRoOk!. But Tark fought the NCAA for decades because the NCAA is a bullshit organization. And that was a lifetime ago, when the bullshit organization still had some credibility.NDballer13 wrote: ↑Fri Mar 06, 2020 1:55 pmThat's just a step in the process, if the NCAA decides to go that route. I have fonder opinions of Tark fighting the NCAA than his coaching success.DCHawk1 wrote: ↑Fri Mar 06, 2020 2:58 pmYou know...I hate to even bring him up, because I know that there are posters who will immediately respond: BuT hE wAs A CRoOk!. Holy shit, did he build a badass team. One of my favorite basketball memories was attending the UNLV-Arkansas game at Barn Hill.
