For 2nd degree there would have to be more evidence of an intent to kill, or extreme recklessness.

I wouldn't try a jury against an officer these days with a murder 1/2.
The previous officer that the attorney defending Chauvin defended was charged with 2nd degree manslaughter and was acquitted.
The dude killed Philando Castile while he sat in his car, cooperating, b/c he 'feared for his life'.

So here the 3rd degree murder seems to be the one to go with.

yeah, cops never seem to get the book thrown at them.

and no to cases are the same.

Castile had a gun, was in a car, and was cooperating when the cop flipped, fired 7 shots, and that's that, but at least more plausibly fits into the "fear for my life" defense.

Lloyd was unarmed, had been searched and in police custody, handcuffed faced down on the ground, and pleaded for his life for several minutes. How is that cop gonna argue that he feared for his life?

Not to mention how hard it is to say you feared for your life when you have your hands in your pockets while you constantly adjust your weight to keep your knee on Floyd's neck with as much force as possible.

for real.

not that previous cases of cops killing people of color haven't been egregious, but this one just seems particularly so.

I kind of wonder what prosecuting a cop to the fullest extent of the law would do.

but rather than say, "we want to make an example of this one in an attempt to discourage future police brutality," they were still reluctant to even arrest.
