I think he is getting word that a one sentence ruling from the Supreme Court is coming.

Turns out it's not so good of an idea to put all your eggs into the "get this Court to trample states' rights" basket.

Not that Trump would ever think two steps ahead, let alone ten, but going against the whole "don't interfere with how a state does its own thing" thing would be highly inconvenient for a Court that intends on letting a lot of states do a lot of things.
