Why does he get a vote if he hasn't been sworn in yet? He's not "legally" a member of Congress - is he?

apparently he also voted on the House omnibus bill, even though he hadn’t taken office when the bill went to vote on dec. 23

Great line I heard on the TV machine yesterday, unfortunately I don’t remember who said it. When asked to describe the situation the person said something to this effect: when you talk to a hostage taker and ask “now that you have the hostages what can we give you which will make you release them?” the hostage taker says “no, I really don’t need anything; I just like collecting and holding hostages” - how do you negotiate with them!!!

The only way this gets resolved is if someone puts a motion that says that no one, or their staff, gets paid until the House is in session. Why should they get paid for doing no work?
