The people who did "far less" were charged with far less and those who were charged with "far less" were typically released on bond while awaiting sentencing.

Those that were held awaiting sentencing were being charged for more serious offenses or were deemed flight risks. And keeping them in solitary was probably the safest thing they could do for them. Anyone who actually did "far less" was likely released on bail and served no prison time:
