The technical details around that are not especially clear.KUTradition wrote: ↑Fri Aug 25, 2023 3:45 pm also, lawyer from Palm Beach county has filed federally to bar trump from the race per the 14th amendment
I do not think there is strong support for the notion that Trump must be convicted of any particular crime for that prohibition to apply.
But clearly there needs to be a finding - so who is that, and how exactly does it go? Is it a federal courts issue (because it's a matter of constitutional interpretation)? Or is it a state courts issue (because the way it works on the ground is that he'll appear, or not, on state ballots)?
If the former, do the numerous, final judgments regarding 1/6 defendants suffice? Or does Trump need to have been a party to a proceeding?
If the latter, what happens if two states resolve the question differently, but on completely different sets of facts?
(Much smarter people than me are looking at this from a very nuanced strategic perspective - if the Dems are successful in keeping Trump off the ballot in even one swing state, it probably scares the GOP off nominating Trump. But is that what the dems actually WANT? What a goddamn mess, how fun.)
