I think what Chutkan did is - again - quite smart. She has scheduled a hearing on a possible gag order, a couple weeks out. Since scheduling that hearing, The Defendant has
already come out with additional aggressive language toward judges, counsel and witnesses.
I think what she's doing is letting the prosecutors build a case based
solely on what he's done while obviously on notice. Much in the way that the prosecutors (like the House select committee earlier in the year) are building their cases almost entirely on (1) documentary evidence, and (2) testimony of
Republicans, especially appointees.
