Pushing the judges buttons may not be the best approach.
“In the current overheated climate, incendiary comments can and in some cases already has, led to serious physical harm and worse. I will now allow the defendants to explain why this blatant violation of the gag order would not result in serious sanctions, including financial sanctions and/or possibly imprisoning him,” Engoron said.

The case that Engoron is presiding over—Trump’s New York bank fraud trial—is a civil matter, meaning jail time wasn’t ever supposed to be in the cards, only stiff fines and a threat to ruin his real estate empire.

But now, Trump appears to be facing a very real threat of spending time in jail if his antics continue.

Defense lawyer Christopher Kise immediately apologized for Trump’s behavior, blaming the 2024 Republican presidential candidate’s bloated “campaign machinery” for simply forgetting to remove a webpage that mirrored the Truth Social post Trump had already deleted.

To Donald Trump, the truth is whatever he decides it is. In the wake of Sidney Powell’s plea deal and despite claiming that she had joined his legal team in 2020, the former president is now alleging she was “never” his attorney.

“Despite the Fake News reports to the contrary… MS. POWELL WAS NOT MY ATTORNEY, AND NEVER WAS. In fact, she would have been conflicted,” Trump posted to Truth Social on Sunday morning.

Trump also said that Powell “was one of millions and millions of people who thought, and in ever increasing numbers still think, correctly, that the 2020 Presidential Election was RIGGED & STOLLEN [sic], AND OUR COUNTRY IS BEING ABSOLUTELY DESTROYED BECAUSE OF IT!!!” (The election was decidedly not stolen and was, in fact, “the most secure in American history.”)

He is coming - slowly - to the awareness of why the RICO statutes exist in the first place. The whole POINT is to neutralize what he foolishly thought were firewalls of deniability and buck-stops-elsewhere mob-style quackery.

A low level stooge gave them Sidney Powell.*

The Kraken gave them Kenneth Chesebro.

The Cheese will give them the other lawyers^ (Eastman and Giuliani).

The other lawyers (Giuliani in particular), along with Meadows and others, will give them King Griftalot.

The whole thing is designed to tighten the noose so much that a sane defendant wouldn't even chance it at trial.+

* There is suggestion out there that, as a legal matter, Trump's statement that Powell would have been conflicted out of representing Trump (because of her representation of Mike Flynn) puts Flynn's pardon at risk. If THAT is the case, then you can add Flynn to the list of those who will give Trump up rather than go to prison...if Flynn doesn't flee the country first.

^ Perhaps "law school graduates" would be more accurate, given the licensing, ah, challenges these two are facing.

+ lol we know Trump won't plea. He'll run to Qatar first.

This isn't even the funnest one.

The DC case judge (Chutkan) granted a temporary stay of her gag order pending appeal,* which would have prohibited Trump from making certain types of statements about the prosecution and potential witnesses. While that gag order was temporarily stayed, he both (1) made those types of statements about the prosecution and potential witnesses, and (2) violated the NY judge's standing gag order.

He is BEGGING to be thrown in jail, for the socials. Engoron might do it. Chutkan won't. But she will make things progressively harder and harder on him,^ and push his buttons (perhaps until he decompensates entirely and suffers an actual mental breakdown).

* The appeal will fail, of course. But Chutkan will keep giving him every benefit of the doubt on stuff like this. Hint: if the judge in your case gives you every benefit of the doubt, the legal term for your situation is, "YOU FUCKED."

^ It is LONG past time for his passport to be pulled.

The most intriguing of Smith's team's recent filings has been the signal that they can prove WHY Trump kept the documents. Certainly seems like the most benign explanation is that he was selling access to himself by way of Mar-A-Lago and Bedminster memberships and events. And I do not believe, for a second, that the Aussie Submarine Storytime Hour was anything like the most egregious or dangerous thing he's done with the information and documents he kept.

And of course - he's obviously going to be a witness for the prosecution. So, whether it's C- grade-school insults or much more serious statements (where Trump makes statements about what he actually did tell this guy), this is exactly the sort of thing the various judges have been telling Trump he cannot do.
