Setting aside the legalities - the person that is going to prison was doing her job and (I believe) made a mistake. The person who walked free (and is now paid appearance fees at Q rallies) inserted himself into a dangerous situation he had no business being at, and knowingly shot three people.

But that’s the thing, though! The prosecution just won a conviction on the arguement that she WASN’T doing her job, was reckless and negligent, and didn’t follow policies or training.

Yeah it seemed like an honest mistake, but that mistake still killed someone who was otherwise not a threat. To frame it as “just a mistake on the job” seems to downplay it; to inappropriately equate it to something more trivial. It’s not like she just forgot to follow dress code and tuck in her shirt or something.

I’m not sure I agree with the idea that holding a killer accountable (when they otherwise so often would not be) is an indication of societal decline.

Though, yeah, I agree the whole Kyle circus is totally fucked.

I am trying to relate to this mistake and am going back to my experiences in the kitchen. It was fast and stressful, although not life or death. Without looking, I had to know where everything at my station was; steaks, veal, chicken, shrimp, salmon, onions, garlic, white wine, olive oil, S&P, lemons, veggie setups, tubs of sauce, steam table set up, plates, tongs, towels, and about 100 other things. I had to grab and go without thinking. If I grabbed the wrong thing, I knew it and replaced it. Fast.

The more I think about it, the more I wonder how she could have thought a gun was a taser. She had years of experience. I dunno. I don't think she had malicious intentions. But she killed a guy. She should not be a cop, and she should probably serve some time.

I'm not at all suggesting there shouldn't be severe consequences. But the two outcomes just make so little sense when juxtaposed against each other.

I suppose a big difference is one was able to claim self defense, and the other shot an unarmed non-threatening driver trying to flee.

But yeah, one is uniformed law enforcement, and the other is an underage kid playing dress up.

One got her issued service weapons confused, and the other intentionally brought a military-style weapon to a riot.

One was on the clock, and the other was out past curfew taking matters into his own hands.

One is now behind bars, and the other is now the keynote speaker at political rallies.

Any stats on how many white people have been “accidentally” shot by white cops thinking that their gun was a taser? Seems to have happened more than once to non-white victims.

What about a test for every law enforcement officer who is issued lethal weapons where they distinguish between a taser and a service weapon while blindfolded ten consecutive times? If they pass with a 100% score they get their weapon. Otherwise they start over. This test then enters their permanent record. Will save our legal system a lot of trouble because the next time a cop claims (s)he was confused the legal system pulls up the test results and sends them directly to sentencing.

As always, I recommend you do what you can to be on it. Almost all jurors are glad they did after it's over.

Don't be an asshat at voir dire, though (if it gets that far, a great chance that you won't). The Judge will see right through you and won't mark you as "duty served" and you'll be right back in there.

The one time I got jury duty it happened to be a contractor who was up on criminal charges of fraud. I didn't get seeelected so I'm not sure how it came out.

As scary as it sounds, I kind of agree with Mich, it really is a civic duty. I also understand that it's not feasible for a small business owner to take that time off.

You likely will not be selected. Also, there may be way to petition the court to be excused.

I figure there's a decent chance I won't get selected...I'm educated and pretty opinionated...not the usual choice for a lawyer.

I dunno....in typical circumstances I'd be happy to participate....trying to get the business off the ground and (keep it in the air) support a family makes that will to participate diminish.

Yeah, last trial this guy was just a real trashy jerk that felt no one was worth his time--not in a I'm-super-important way but more in a fuck-everybody way. Anyway, several different times he told the Judge that "CnB's corporate client is evil and I will always find against them no matter what." I can't possibly do this without fucking them over, all in a very white trash angry asshole tone. This went on for several minutes and Judge was annoyed at the guy said his behavior was unacceptable and disingenuous and told him to leave but he would be back there very soon.

I think there are at least a couple different ways to easily get yourself struck for cause without being an asshat, but again, I think everyone should do it genuinely. I would love to be on one. If you have conflicts at home or work, just be honest and have a convo with the Judge about what they are. It's pretty easy to tell what a real hardship is and what is not. I have the most sympathy for the single parents, etc.
