Trump is not facing any charges for inciting a riot.
One count of conspiracy to defraud the United States applies to Trump's repeated and widespread efforts to spread false claims about the November 2020 election while knowing they were not true and for allegedly attempting to illegally discount legitimate votes all with the goal of overturning the 2020 election, prosecutors claim in the indictment.
One count of conspiracy to obstruct an official proceeding was brought due to the alleged organized planning by Trump and his allies to disrupt the electoral vote's certification in January 2021.
One count of obstruction of and attempt to obstruct an official proceeding is tied to Trump and his co-conspirators' alleged efforts after the November 2020 election until Jan. 7, 2021, to block the official certification proceeding in Congress.
One count of conspiracy against rights refers to Trump and his co-conspirators alleged attempts to "oppress, threaten and intimidate" people in their right to vote in an election.

Hell, on Page 2 of the Indictment, item #3 in the Introduction, it clearly states "The Defendant had a right, like every American, to speak publicly about the election and even to claim, falsely, that there had been outcome-determinative fraud during the election and that he had won. He was also entitled to formally challenge the results of the election through lawful and appropriate means, such as by seeking recounts or audits of the popular vote in states or filing lawsuits challenging ballots or procedures. Indeed, in many cases, the Defendant did pursue these methods in contesting the results of the election. His efforts to change the outcome in any state through recounts, audits or legal challenges, were uniformly unsuccessful."

Trump, in a post on Truth Social early Friday, repeated accusations that President Biden is pushing for the cases against him for political purposes. Trump also said the multiple cases against him will require “massive amounts” of time and money and force him to use resources on court battles that could have been used for advertisements and rallies.

They got what they wanted, a supermajority of younger, right-minded, obedient jurists. So, who needs Trump with his unique ability to create chaos and inspire the opposition like no other?

They’re like a bizarro version of that friend we all have, who has to top every single story.
They’re constantly accusing (often without evidence) Ds of recreational-grade offenses, knowing there’s hard evidence out there of them doing medical-grade offenses.

I've been struggling a bit to articulate it, but the nonsense free speech bleatings from and around Team Trump (and the R media ecosystem) have seemed...familiar.

And of course also the very curious manner in which Musk started hinting at "government weaponization" right around the time in January that he knew he'd turned The Defendant's information over to Smith's investigators.
And of course not to mention the varying coyly-to-overtly ways in which Musk has showed far-right sympathies.
I suspect what we're seeing is the autocrats and the technocrats share the same poisoned circulatory system. And so naturally the same broke-ass, galaxy-brained theorizing suffuses what are essentially common arguments: different rules for me than for you.
