It is unfortunate that the NCAA is not a forward thinking organization,
The NCAA has a lot of problems and putting the screws to the schools for something shoe companies are doing is not the smartest move.
You look at what was going on in football and the four super conferences with sixteen teams that walk away from the NCAA. I don't think anyone put the billion dollar march madness basketball tourney in the equation.

The defiant intensity of KU’s response — which includes three separate Level I violations — was expected. Yet it is still something to behold when actually put to paper. There is little cooperation here. There are few admissions. This is a direct confrontation, much like a legal case in which guilt or innocence is an all-or-nothing proposition.

Right - and the NCAA has made clear that it will not play fair, or give any credit for cooperation/admissions.

You can contract out of the right to bring claims in court. You probably do it all the time without really paying much attention (have a look at, say, your credit card or cell phone terms of service).
I gather, from the way the various committees are described here, that there's language in the bylaws or somewhere else where schools purportedly give up their right to appeal decisions in court. That won't stop KU from trying, but they'll be fighting the words on the page.

This has certainly put a 'stain' on the KU name forever but it is still best for KU to keep pushing this as long as possible. Go the UNC route; don't back down and eventually the NCAA will cave. With as fast as this world is moving these days and the hot button that has become amateur sports KU should hold fast and firm on its stance.

You know...I hate to even bring him up, because I know that there are posters who will immediately respond: BuT hE wAs A CRoOk!. But Tark fought the NCAA for decades because the NCAA is a bullshit organization. And that was a lifetime ago, when the bullshit organization still had some credibility.
