This. They are hiding behind "he isn't President any more so this is unconstitutional" so that they do not have to admit that Trump clearly did what he is charged with doing because we all saw him do it live on national TV.

Had anyone paid attention to the whole Trump’s legal defense team story?

He couldn’t find any lawyers willing to represent him - have you heard this one before? - til he got some random South Carolina goofs recommended by Lindsey Graham. Then recently, just days before the trial is set to begin, he and his lawyers abruptly parted ways - no really, have you?

I guess the source of the dispute was that the lawyers wanted to focus on arguing that impeaching a potus who’s left office is unconstitutional, as well as debating the definition of “incitement.”

Trump, however, insists on doubling down on the argument that he won the election.

It's of a piece with real lawyers never having actually tried to make these arguments in the post-election litigation.

Their licenses are on the line, not just their reputations.

Not bad, but I would have prefaced this with something like "Trump incited a mob, huh? And that resulted in the deaths of five police officers, huh? Well, how many people died in BLM rallies last year? Huh? Huh?"
