Kansas Supreme Court Rules State Constitution Protects Right To Abortion

The Kansas Constitution protects a woman's right to an abortion, the state's supreme court ruled Friday.

The landmark ruling now stands as the law of the land in Kansas with no path for an appeal. Because it turns on the state's constitution, abortion would remain legal in Kansas even if the Roe v. Wade case that established a national right to abortion is ever reversed by the U.S. Supreme Court.

The decision continues: "We are now asked: 'Is this declaration of rights more than an idealized aspiration? And, if so, do the substantive rights include a woman's right to make decisions about her body, including the decision whether to continue her pregnancy? We answer these questions, 'Yes.' "

The court continued that "this right allows a woman to make her own decisions regarding her body, health, family formation, and family life — decisions that can include whether to continue a pregnancy."

Well if, over 4 decades later, there is still a substantial number of voters who vote, regardless of the candidate, or the candidate’s red flags, based singularly on the goal of stacking the Supreme Court, in hopes of eventually overturning Citizens United, then maybe.

What’s lost is how different the Federal and Kansas Constitutions are written. Roe is settled law. Kavanaugh said so. And the current court is going to apply it in support of 20 week gestation bans on abortion.

Sure. His point was that Roe is settled law. Cuz he wants it to be. (And Citizens United isn't cuz he doesn't want it to be).

And once upon a time Dred Scott was settled law.

And no, the differences between the federal constitution and Kansas' constitution was NOT lost, on me anyway. I don't particularly care for the decision, but that's what federalism is all about.

When we've changed the culture enough that there is a sufficient majority of Kansans willing to amend the state constitution, then we'll have won. Until then, it is what it it is.
